An alleged drug dealer and an 18-year-old were taken into custody by Scottsburg police on Wednesday evening, August 3.
Ellis L. Riley, 52, and Jesse Todd Fox, 18, both of Scottsburg, were arrested by Patrolman Troy Ford. The pair were backseat passengers in a green Honda that was stopped for a traffic violation near the corner of Jefferson and South Third Streets in Scottsburg.
The probable cause affidavit stated that Ellis and Fox made “...furtive movements...” in the back seat after the stop was made and had to be told several times to keep their hands in view.
When Ellis was searched, a red container in his back pocket contained 4.35 grams of methamphetamine, the report stated. He was also allegedly had a vial concealed at his belt which contained the illegal homemade drug and a syringe in his rear pocket. His wallet, officers discovered, had several small baggies used by dealers to package narcotics. Among the money Ellis had, police found two marked bills that had been used for “control” purchases by undercover agents.
Fox had a backpack on his lap, which he allowed officers to search. Purported drug paraphernalia located in the backpack included cut straws and a bent spoon. Fox told officers that Riley had handed him the backpack as the car was being stopped. Riley allegedly said the backpack “....might have been his, who knows...”
Fox was charged with possession of drug paraphernalia, a Class C misdemeanor. The charge was filed in Scott Superior Court, and he appeared for his initial hearing on Friday, August 5.
A not guilty plea was entered for him, with bail set at $5,000 by corporate surety bond or $500 cash. The case was assigned to a public defender with an initial trial date of October 4.
Fox was allowed release on his own recognizance to await that trial.
Ellis remains at the Scott County Security Center on charges of Level 4 and Level 5 felony dealing in methamphetamine, Level 6 felony unlawful possession of a syringe, Class A misdemeanor dealing in a Schedule 4 controlled substance and Class C misdemeanor possession of paraphernalia.
All of those charges were filed in Scott Circuit Court, where Ellis appeared on August 5 for his initial hearing. A preliminary plea of not guilty was entered for him, and bail was set at $25,000 by bond or $5,000 cash.
Ellis' trial date is scheduled November 22. He is being represented by a public defender.
