Brothers arrested for drug possession at car sales business south of Scottsburg PDF Print E-mail

    Two brothers are out on bail awaiting trials on possession of drugs that were scheduled after their arrests on Thursday, March 5.
    The case developed when Scottsburg Patrolman Troy Ford was patrolling in the early morning hours of that Thursday. He stated in a probable cause affidavit that he witnessed “...suspicious activity...” around 4 a.m. which caused the officer to believe a burglary may be occurring at a car sales lot at the corner of U.S. Highway 31 South and State Road 356.
    He came into contact with David Shirley, 50, Austin, one of the owners of the sales lot. Ptl. Ford said he discovered Shirley had a quantity of methamphetamine in his possession. Shirley was also found to be in possession of two glass pipes, drug paraphernalia commonly used to burn meth and other drugs. Each was coated with the white residue.
Based on what the officer found, a search warrant was requested and issued through local courts. A search of the business reportedly revealed three grams of meth, glass pipes, a few Hydrocodone pills and other paraphernalia.
David Shirley's brother, Donald Shirley, 44, Clifford, was also taken into custody after the search warrant was served around 7 a.m. on March 5. Donald Shirley's truck was parked at the business. Chief Deputy Wayne Williams conducted a search of that vehicle and reportedly found a cigarette box that contained four 7.5 mg Hydrocodone pills.
Donald Shirley was questioned at the site by officers; the probable cause affidavit stated that he said the pills were his, but he was unable to provide a prescription for the controlled substance.
    Donald Shirley was charged with one count of possession of a Schedule 1, 2 or 3 controlled substance, a Class D felony. He was cited into Scott Superior Court on Friday, March 6, where he entered a not guilty plea.
He posted his bail of $15,000 corporate surety/10% cash that same date and was released to await his trial on June 9.
David Shirley faces charges in Scott Circuit Court. He is charged with two counts of possession of meth, both Class C felonies; maintaining a common nuisance and possession of a Schedule 1, 2 and 3 controlled substance, both Class D felonies; and possession of paraphernalia, a Class A misdemeanor.
    His bail was originally fixed at $50,000 cash or corporate surety. He too posted bail on March 6 and was released to await his trial date of August 10.
    David Shirley was scheduled to return to court on Monday, March 16, for a review of his decision to employ an attorney.
